Terms

These terms govern your use of Confetti Cross Stitch (the app and the conversion service behind it), operated by Ackee & Software Limited. By downloading or using the app, you agree to them. If you do not agree, do not use it.

WHAT THE APP DOES

Confetti Cross Stitch converts cross-stitch chart files you already own into a chart you can follow on your device, creates charts from your own photographs, and keeps track of what you have stitched.

YOUR PATTERNS ARE YOURS

You keep every right you have in the files you add. We claim nothing over them, and use them only to convert them for you. You are responsible for having the right to use the patterns and photographs you bring, and for respecting the terms of whoever designed or sold them.

CONVERSION IS BEST EFFORT

A conversion is a reading of someone else's file, and it can be wrong. Every pattern comes with a confidence report saying how the answer was arrived at and what could not be checked. Check a chart against your original before you buy thread or start stitching. We are not responsible for materials, time or work lost to a conversion that turned out to be wrong.

CREATED PATTERNS

A pattern created from a photograph is a new chart made to your settings. It is not a reproduction of a published design, and what you photograph is your responsibility.

ACCEPTABLE USE

You agree not to: use the app to break the law or anyone's rights, including a designer's copyright; try to reach the conversion service other than through the app, or to get unauthorised access to it or our systems; reverse engineer or decompile the app; send anything harmful, such as malware; or resell or offer the app or its conversions to others without our written permission.

SUBSCRIPTIONS AND BILLING

The first 14 days are free, and no card is needed. After that, Confetti Cross Stitch is a yearly subscription bought through the App Store or Google Play, at the price shown before you buy. It renews automatically unless you cancel at least 24 hours before the current period ends. You manage and cancel it in your Apple Account or Google Account settings; deleting the app does not cancel it.

Payments and refunds are handled by the store you bought from, under its own policies and terms (for the App Store, Apple's standard licence terms). We never see your payment details and cannot issue refunds ourselves.

If your trial ends or your subscription lapses, nothing is deleted. Every pattern still opens and shows everything you have stitched; marking stitches, adding patterns and the other working tools pause until you subscribe again. Exporting a pattern becomes available once you have paid for a subscription, and stays available after you cancel.

OTHER SERVICES WE USE

The app relies on Railway, Google Firebase, RevenueCat, PostHog, Resend and the store you bought from, as described in the privacy policy. Your use is also subject to their terms and policies, and we are not responsible for what they do or fail to do.

AVAILABILITY

The conversion service may be unavailable, slow, or changed. Patterns already on your device keep working without it.

YOUR PATTERNS LIVE ON YOUR DEVICE

Your patterns and progress are stored on your device, not with us. If the device is lost or the app is deleted, they go with it, and we cannot restore them. Keep your original pattern files.

NO WARRANTY

The app and the conversion service are provided as they are and as available, without warranties of any kind, express or implied, to the fullest extent the law allows. That includes any warranty of merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We do not promise that a conversion will be correct, that the service will be available at any given time, or that anything on your device will be kept.

LIMIT OF OUR LIABILITY

To the fullest extent the law allows, our total liability for any claim arising from the app, the service or these terms is limited to the greater of what you paid us in the twelve months before the claim arose, or US$100. We are not liable for any indirect, incidental, special, consequential or punitive loss, including lost profits, lost data, or thread, fabric, time or work spent on a pattern, even if we were told it could happen. Some places do not allow some of these limits, so they may not all apply to you.

INDEMNITY

You will cover Ackee & Software Limited against claims, losses and costs (including reasonable legal fees) arising from your use of the app, the files you bring to it, or your breach of these terms or of anyone else's rights.

ENDING

You can stop using the app at any time by deleting it; cancel your subscription separately, as above. We may suspend or end your access if you breach these terms, if the law requires it, or if we stop offering the app.

CHANGES

We may change, suspend or stop any part of the app, and we may update these terms. If these terms change, the date at the top of this page changes with it; if a change is material, we will give reasonable notice first. Using the app after a change means you accept it.

GOVERNING LAW

These terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute — except that either of us may bring an individual claim in a small-claims court.

THE WHOLE AGREEMENT

If any part of these terms cannot be enforced, the rest still applies. These terms and the privacy policy are the whole agreement between you and us about the app.
